JACKSONVILLE, Fla. -- The trial for the accused killer of Cherish Perrywinkle has been delayed.
Donald Smith was set to stand trial in May, but his trial on Wednesday was rescheduled for October. The decision was made during a pre-trial hearing.
Smith has pleaded not guilty to murder, kidnapping and sexual battery related to the death of 8-year-old Cherish Perrywinkle.
His next pre-trial hearing is set for July 16 and the final pre-trial hearing will be on October 2.
The trial is set to take place during the weeks of October 6 and October 13 with jury selection starting on the 6th.
The registered sex offender is facing death row in the rape and murder of Cherish Perrywinkle.
According to police, Smith kidnapped the 8-year-old girl from Walmart on Lem Turner road back in June. Cherish's body was found near a creek off Broward Road.
Smith is charged with first degree murder, kidnapping and sexual battery.
