
JACKSONVILLE BEACH, FL -- A man who was found sleeping naked on the couch is under arrest. It wasn't his couch.
Police say they got a call shortly after 3 a.m. Sunday from a 72-year-old woman who said someone had broken into her house in Jacksonville Beach.
According to the police report, the woman heard glass breaking and though someone had broken a window.
What had actually happened is that 27-year-old Nickolas Edward Rust had kicked in her door to break in, and then broke a vase as he went through the dining room.
He then took his clothes off and went to sleep on her couch, which is where he was when police found him.
The woman told police she doesn't know the man, and he wasn't supposed to be there.
The officer on the scene noticed that Rust appeared heavily intoxicated and wouldn't comply with the officer's request to get off the couch.
The officer then removed Rust from the couch and arrested him.
Rust is charged with trespassing and disorderly intoxication, both misdemeanors.
He has been released on bond, and when First Coast News tried contacting him today, a man who identified himself as Nickolas Rust said he had been at a concert Saturday night.
When asked if he slept in someone else's living room, he replied, "That's what they tell me."
He also indicated this is the only time he's been in trouble with the law.
