Settlement reached in lawsuit regarding 3-year-old boy who drowned in septic tank

The information comes following an investigation by the Department of Children and Family into the death of Amari Harley, 3, on Oct. 22, when the Jacksonville Sheriff’s Office discovered his body after he went missing during a birthday party.

A settlement has been reached in the lawsuit against ERS Corporation, the contractor responsible for the septic service where a three-year-old drowned last year.

The information comes following an investigation by the Department of Children and Family into the death of Amari Harley, 3, on Oct. 22, when the Jacksonville Sheriff’s Office discovered his body after he went missing during a birthday party.

His body was found in a water tank underground. The family believes the boy drowned after he somehow got through a plastic lid that at one time covered the tank. Officials with the city have since replaced those covers.

The amount of money awarded in the case has not been disclosed.

The attorney is planning a secondary lawsuit to include the City of Jacksonville. 

There are 400 parks in Jacksonville. Bruce Park is one of 76 parks with septic tanks or lift stations for restrooms. Like all systems, each month these tanks are inspected.

Jacksonville Mayor Lenny Curry has not commented on whether or not the city would face charges if found liable.
