Man accused of raping and kidnapping woman from NW Jacksonville gas station

Officers say that the victim advised them that she was at a gas station on Lem Turner Rd Sunday night when a man walked up behind her, put a gun to her back, and told her to get into the passenger's seat of the vehicle.

A man was arrested, accused of raping and kidnapping a woman from a NW Jacksonville gas station Sunday night, says the Jacksonville Sheriff's Office.

Billy Ray Gaines, 20, was taken into custody by JSO on Monday on charges of armed sexual battery, resisting an officer without violence, fleeing or attempting to elude law enforcement, carjacking, and kidnapping during the commission of a felony.

Officers say that the victim advised them that she was at an unknown gas station at 11:30 p.m. in the 10100 block of Lem Turner Rd when a black male walked up behind her, put a gun to her back, and told them to get into the passenger's seat of the vehicle.

The victim told JSO that at some point during the car ride Gaines stopped the vehicle at an unknown location and forced the victim into the back seat where he raped her. The victim says that while she was performing these sexual acts, Gaines had the firearm in his hand.

According to JSO, the victim told officers that she was then taken to a residence where she got out and phoned the police. The victim said the suspect drove off in her vehicle and did not return. According to the victim, Gaines continued to text her to tell her where he was going to leave the vehicle. 

Around 3:00 a.m., a JSO officer was on a routine patrol in their marked vehicle actively looking for Gaines. The officer got behind a Ford Explorer traveling eastbound on Golfair Blvd which matched the description of the vehicle given, according to police documents. As the officer approached the vehicle JSO says it began to speed up and make multiple evasive turns in an attempt to get away. As the vehicle turned left onto West 20th Street, it lost control and began to spin out of control.

 According to police, the vehicle ran over a chain link fence on the Southside of West 20th Street and came to a stop in a vacant lot. The suspect exited out of the driver's door of the vehicle. 

Police say Gaines jumped a chain link fence and began to run away from officers but was later taken into custody after a "brief foot pursuit". 

Angela Cooley heard the chaos unfold feet from her bedroom early Monday morning between the suspect, officers and a K9 unit.

"He jumped over the fence then I heard police yell, get on the ground, get on the ground now, then I heard them pull into my front yard," said Cooley. 

"It was on my front porch, I heard everything, about four or five cops, and they had the dog on him and I had six police cars in front of my house and the next thing you know they haul him off to jail."

Former JSO detective Kim Varner advises that whatever you do in that situation, don’t get in the car if you can help it.

"When you leave with them statistics show you end up being raped or possibly murdered," said Varner.

He says make a commotion and be loud because it could save your life.

"Make noise, scream, draw attention to that person, let other people know around you what’s going on," he said. 

Gaines was transported to the Duval County jail without incident. He is not eligible for bond.

His next date in court will be Jan. 9, 2019.
