Re-trial of Michael Dunn moving forward on schedule

JACKSONVILLE, Fla. -- Michael Dunn, 47, appeared in front of a judge for a brief hearing Monday morning. Both prosecutors and the defense agreed to have all motions related to the August 4 pre-trial hearing submitted by July 28.

Dunn is charged with first degree murder for the shooting death of 17-year-old Jordan Davis. It happened in November 2012 at a gas station on the city's Southside.

The two got into an argument over the volume of music coming from the SUV Davis was inside. Dunn argues he opened fire on the vehicle because he believed the teen was armed. No weapon was ever found at the scene.

Earlier this year, a jury failed to reach a verdict on the first degree murder charge. However, the jury did convict Dunn on multiple counts of attempted second degree murder for the other people inside the SUV when Dunn started shooting.

Dunn faces at least 60 years in prison for the crimes he's been convicted of. He won't be sentenced on those charges until after his murder retrial is finished.

Jury selection in Dunn's murder retrial is scheduled to begin September 22, with opening arguments to follow the week after that.
