ORLANDO, Fla. -- A man who killed and sexually assaulted an aspiring artist in central Florida is scheduled to die by lethal injection.
Kimbrough was convicted in the 1991 slaying of Denise Collins. The 28-year-old woman was attacked in her Orlando apartment while she was sleeping.
In October, the state Supreme Court denied Kimbrough's appeal, rejecting the argument from Kimbrough's lawyers that he shouldn't be executed because the jury recommendation wasn't unanimous.
Kimbrough was convicted through an eyewitness account placing him at the apartment complex and through DNA testing.
His attorneys have appealed to the U.S. Supreme Court, saying the eyewitness was elderly and had memory lapses and that the DNA testing was faulty. They also say his trial attorneys were not allowed to present evidence that her ex-boyfriend may have killed her.
