JACKSONVILLE, Fla. -- The operator of an unlicensed daycare center has been charged in the drowning death of a two-year-old at its facility.
Jan Marie Buchanan, 46, has been charged with Aggravated Manslaughter of a Child Under 18 by Culpable Negligence and Operating a Family Day Care Home Without a License.
Steven Spurlock, 2, was pulled from the pool at Kiddie Heaven on May 21 and taken to Wolfson Children's Hospital in critical condition. The center was ordered by the Florida Department of Children and Families to cease operations. Steven died on Saturday.
Buchanan talked with Jacksonville Sheriff's Office detectives on Tuesday and told them she forgot to lock a child gate on a sliding glass door, did not lock the child pool gate and did not have the pool alarm set, JSO Lt. Rob Schoonover said.
There were a total of seven children in the home at the time -- three one-year-olds, three three- to four-year-olds and Spurlock, who was two.
Schoonover said Buchanan had applied for a daycare license in March but did not follow up with it.
Buchanan is not eligible for bond and her first court appearance will be Wednesday morning at 9 a.m.
