JACKSONVILLE, Fla. -- The Jacksonville Sheriff's Office has identified the man shot outside Club Aqua early Sunday morning as 24-year old Nicholas Underwood.
Chief Tom Hackney tells First Coast News off-duty officer Michael Peterson, a 12-year veteran, shot and killed a man trying to walk into the club with a gun.
JSO says it happened after a bar fight, when the suspect went outside to the parking lot to retrieve his weapon.
Hackney says the man was trying to get back into the club to continue the fight. Two patrons pointed out the armed man , the officer spotted him and tried to stop him, opening fire just a few feet from the entranct to the club.
"Officer Peterson quickly saw the suspect, he was still armed with a handgun, holding it in his hand, and walking toward the front of the club," said Hackney. "Peterson approached the subject, confronted him, reepeatedly ordered himto stop, drop the gun and get on the ground. The subject refused to comply with every one of Peterson's orders. Officer Peterson was concerned not only for the safety of the hundreds of people in the parking lot, but with his own safety with an armed male in the parking lot of an open business, a closed business. He opened fire on the subject, fired five times, striking him and killing him."

Underwood had no arrest record here in Duval County where he lived. He did have misdemeanor charges against him in Broward County.
