JACKSONVILLE, FL -- Some controversial classroom comments are under review and could lead to big trouble for a Twin Lakes Academy Middle School teacher. Patrick Foster is a seventh grade science teacher. He is accused of embarrassing students who disobey the schools dress code. Some say his comments crossed the line.

"Highly, highly believe in the dress code and I do believe it needs to be enforced but I do believe it doesn't need to be enforced in a negative fashion," Amber Hodges said.

Foster is still working but he is no longer teaching while facing a 10 day, unpaid suspension and potential transfer.

"We want to make sure that our teachers are role models and in this case obviously there were inappropriate comments that were made to students," said Jill Johnson with the Duval County Schools.

In a letter from the Duval County School District, Foster is accused of telling a female student what color panties she was wearing because her skirt was too short.

He told boys wearing their pants low or sagging meant they were "open for business."

He also warned his female students not to wear t-shirts with writing across their chest because he said it is distracting.

The Duval County School Board has until October 7th to decide the future of this teacher.

The school administration at Twin Lakes is asking for ten days unpaid suspension and a transfer to another school.
