
JACKSONVILLE, FL - Wilma Scheibe loves her retirement home, but hates her backyard.
"The soil has been washing out since I moved in," says Scheibe.
Scheibe purchased her home September 2008, and says she has complained to the builder about the washout even before she closed on the sale.
"I've told them from day one," She says.
Now, she wants the builder to deliver a load of dirt to fill in the areas already washed out. Scheibe says she has spent $500 to build a retaining wall and she just needs some help.
She says, "If they can deliver a load of dirt I can get it fixed."
They won't. The builder says soil erosion is not a warrantable item.
Something Scheibe recently found out.
The builder says he will meet with the engineer, developer and the Home Owners Association to determine if there's a problem community wide. Then, it will be HOA's responsibility to repair the problem, not the builder.
Also excluded from a builder's warranty are appliances and paint and settling.
