
JACKSONVILLE, FL -- Family of Kiko Battle have more questions than answers as they mourn the death of the 24-year-old who was fatally shot by an off-duty JSO officer late Monday afternoon.
Battle, according to police, had a gun that fell to the street after he was tasered by officers who wanted to question him.
JSO Chief Rick Graham says Battle was a convicted felon who served seven years for robbery and aggravated assault in a Georgia prison.
Graham says Battle was carrying a 9 mm handgun that was reported stolen last year in Jacksonville.
Kanard Battle, Kiko's older brother, visited the scene of the fatal shooting that is just a block away from his grandmother's home.
"Why did they stop and question my brother?" says Battle, who doesn't buy the police explanation that Kiko and his cousin raised suspicion by walking in the middle of the street.
Graham says officers J.C. Nobles and T.L. Terrell were working off-duty for the Springfield Preservation and Revitalization Council.
"As far as what the actual officers based their stop on, we are still waiting on those definitive answers," said Graham.
According to police, Battle offered resistance when approached by the officers.
"Even having been tased, Battle still had enough control to gain control of the gun, to stand up, point it at Officer Nobles," said Graham.
Police say Battle was shot nine times.
The police shooting is the eighth one this year, with five being fatal.
Police say Officer Nobles, a seven-year veteran, was involved in a fatal shooting last year.
