JACKSONVILLE, Fla. -- Local attorney Rick Block said the driver in a fatal accident Friday was also involved in a car crash that killed 6-year-old Kaitlyn Springer in 2009.

According to Block, the driver from that case, 66-year old Michael Fortunato, is the same driver who reportedly struck and killed 57-year-old Esther Ohayon Friday night as she walked to temple at San Jose Boulevard at Haley Road in Mandarin.

Ohayon's 16-year-old daughter Orly was also struck and remains in critical condition at UF Shands. (UPDATE: Sunday 9:48 p.m -- Orly Oyahon has been upgraded from critical to stable condition.)
Nora Springer, mother of Kaitlyn, sued the City of Jacksonville citing problems with the crosswalk at San Jose Boulevard and Kori Road, but the case was dropped, according to Block.
Block is a personal injury attorney and represented the Springer family in the lawsuit.
Block said his main goal is to change the laws concerning crosswalks in Jacksonville.
According to Duval County court records, Fortunato has a history of traffic violations including speeding, running stop signs and driving with an expired license or registration.
According to a public records search by FCN, Fortunato was never charged in the 2009 incident. Block confirmed that.
