ORANGE PARK, Fla. -- A 26-year-old man shot by Clay County Sheriff's Office deputies in December when he allegedly pointed a gun at them is out of the hospital and behind bars.

Clay County Sheriff's Office Deputy Reginald Hyatt shot Nicholas Cannady December 13 at the Mariners Wharf Apartments in Orange Park.

Deputies originally responded to the apartment complex to reports of a suicidal man.

At the time of the shooting, the Sheriff's Office said Cannady approached Deputy Hyatt and another deputy with a gun and allegedly pointed it at them.

Clay County Fire Rescue personnel transported Cannady to the Orange Park Medical Center in critical condition.

Mary Justino, Public Information Officer for the Clay County Sheriff's Office, said Orange Park Medical Center staff determined Cannady was well enough to be discharged over the weekend.

Once he was discharged, Justino said deputies took Cannady into custody.  He is being held on charges of attempted murder and assault on a law enforcement officer.

The Florida Department of Law Enforcement investigation into the officer-involved shooting is still ongoing, Justino said.  Deputy Hyatt has returned to his patrol assignment, according to Justino.
