JACKSONVILLE, Fla. -- Court documents were released Monday in the case of Jacksonville's youngest murder suspect.
Documents show 13-year-old Cristian Fernandez claimed his stepfather abused him, and that's what made him so angry at his two-and-a-half year old half-brother.
Fernandez pleaded guilty Feb. 8 to manslaughter and aggravated battery.
Fernandez killed his two-year-old half brother David Galarriago at their
apartment in 2011 when he was 12 years old. He spent his 13th birthday
Now that he's plead guilty to manslaughter the confession is public record, but a jury would have never seen it.
judge threw out his confession, saying he was too young to understand
waiving his Miranda rights, and there was no adult advocate in the room
In the video, Fernandez
has a long and halting conversation with a female detective the night David was taken to the hospital.
He told the investigator his mother wasn't home when he pushed his brother, and he lied to her about what happened that night.
He goes on to tell the detective that his mother cleaned the two year
old up, and changed his clothes, and was searching on the internet for
hours before calling police.
Documents also said Fernandez's stepfather killed himself in front of Fernandez's siblings after learning he was about to be arrested for child abuse while the family was living in Miami.
Along with the video, the State's Attorney released hundreds of pages of police reports and interview transcripts detailing what happened after that interview.
At one point in the hospital, an officer reports telling David's mother that he wasn't going to make it and she replied that she had been through worse.
Cristian's mother has terminated all of her parental rights and pleaded guilty to aggravated manslaughter in David's death last year.
Fernandez will be in jail until he turns 19. Once released, Fernandez will be on probation for another 8 years.
