Family of Jordan Davis files civil complaint against his suspected killer

JACKSONVILLE, Fla. -- The attorney representing the family of 17-year-old Jordan Davis, who was shot and killed outside of a gas station in November, has filed a civil complaint against the man accused in his death.

The office of John M. Phillips filed the complaint against 45-year-old Michael Dunn on behalf of Jordan's parents, Ron Davis and Lucia McBath, on Thursday morning.

Dunn is currently charged with the murder of Davis and is in the Duval County Jail.

The complaint cites counts of negligence resulting in wrongful death, gross infliction of emotional distress, negligent infliction of emotional distress, intentional infliction of emotional distress for Ron Davis, and intentional infliction of emotional distress for Lucia McBath.

"Notable in the complaint is not just the usual wrongful death and infliction of emotional distress claims, but defamations claims arising out of Dunn's lawyer(s) attempts to litigate this case in the media with false information," a release from Phillips' office said.

Davis, a Wolfson High School student, was fatally shot the day after Thanksgiving in a gas station parking lot after an argument police say was started over loud music.

Phillips is also representing two passengers that were in the car with Davis, Leland Brunson and Tevin Thompson, who have also filed a complaint against Dunn.

The counts listed on that complaint cite gross infliction of emotional distress as to Leland Brunson, gross infliction of emotional distress as to Tevin Thompson, negligent infliction of emotional distress as to Leland Brunson, negligent infliction of emotional distress as to Tevin Thompson, defamation as to Leland Brunson and defamation as to Tevin Thompson.
